1 Eligibility & Account Registration

• Eligibility: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to open a commercial merchant account on Website Builder.
• Account Authenticity: You agree to provide accurate, truthful, and up-to-date business and contact information (including your legal name, business title, and valid WhatsApp phone number).
• Account Security: You are responsible for maintaining the confidentiality of your credentials and all activities occurring under your account. You must immediately notify us if you suspect unauthorized access.

2 Merchant Storefronts & Acceptable Use

Website Builder grants you a non-exclusive, non-transferable, revocable license to create and manage digital storefronts, upload product catalogs, configure appointment services, and connect customer communication channels.

Prohibited Content & Activities: You strictly agree NOT to publish, upload, or sell:

• Counterfeit, stolen, unauthorized, or trademark-infringing goods.
• Illegal drugs, controlled substances, weapons, explosives, or hazardous materials.
• Explicit adult content, pornographic media, or non-consensual sexual material.
• Malicious software, phishing schemes, automated bot spam, or fraudulent investment solicitations.
• Content that promotes violence, hate speech, defamation, or discrimination based on race, religion, gender, or disability.

3 Direct WhatsApp Commerce & Zero Commission Structure

Website Builder facilitates direct peer-to-peer and merchant-to-customer commerce via encrypted WhatsApp checkout messaging (https://wa.me/):

• Zero Transaction Fees: We do not take transaction cuts or commissions on sales generated through your storefront.
• Direct Fulfillment & Payments: All product deliveries, customer fulfillment, and monetary exchanges (cash-on-delivery, UPI, bank transfer, payment links) are conducted directly between you and your customers.
• No Middleman Liability: Website Builder is not a merchant of record, escrow agent, or delivery partner. We are not liable for order disputes, refunds, product quality, or delivery delays.

4 Subscription Plans, In-App Purchases & Renewals

Website Builder offers optional annual subscription upgrades (e.g. 1 Website, 3 Websites, 5 Websites) providing increased storefront hosting capacity and premium feature access.

• App Store Billing: On Android devices, billing is processed securely by Google Play In-App Billing. On iOS devices, billing is processed securely by Apple StoreKit.
• No Storage of Payment Cards: We never receive, store, or process your credit/debit card numbers or CVVs.
• Auto-Renewal & Cancellation: Subscriptions automatically renew unless cancelled at least 24 hours prior to the end of the current billing cycle. You can manage and cancel your subscriptions anytime through your Google Play Store Account or Apple ID Settings.
• Refunds: Refund requests are governed by Google Play and Apple App Store refund policies and must be submitted through their respective store support centers.

5 Intellectual Property Rights & Merchant Ownership

• Your Content: You retain complete ownership and intellectual property rights to your product photos, logos, branding, product descriptions, and storefront text.
• License to Host: By uploading content, you grant Website Builder a worldwide, royalty-free license solely to host, render, and display your catalog on the web as directed by you.
• Platform Ownership: All application software, user interface designs, themes, and proprietary algorithms remain the exclusive property of ShanApps.

6 Termination & Account Deletion

You may terminate your account and delete your storefronts at any time directly through the app settings:

• Store Deletion: You can delete any storefront under Manage Storefronts → Delete (authenticated via biometrics).
• Permanent Purge: Deletion requests permanently erase catalog records, orders, and images from our live databases in compliance with Google Play Data Safety and GDPR/CCPA standards.

7 Disclaimer of Warranties & Limitation of Liability

Website Builder is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, ShanApps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenues resulting from your use of or inability to use the service.
